Open access land innit? The gate might have to come off soon enough anyway which will make things a whole lot easier for absolutely anybody who wants to visit or is it classed as a working mine?

There is no consensus that CRoW will override the mine and quarries act.

I am aware that a member of the BCA executive (who is doing a shed load of work on CRoW) believes that non-working mines will be covered but it isn't shared by many.

Further, the Cambrian Caving Council (Welsh arm of the BCA) are making no proposals in that direction.

The gate is to protect the landowner's land / property and stop sheep and any other farm animals from getting out. Also to attempt to stop off-roaders from churning up his land illegally. He periodically takes slate blocks off the tips but not from the mine. Thus the gate is not specifically to stop access to the mine... Free access is available on foot by using the kissing gate adjacent to the road gate.

No, the other gate. Lake Level adit gate. The smoke flue too. If anyone can make it up there that is having already done the huge climb up from the car park to the lake noting recent complaints on here...:tongue:

I would suspect that Marty is alluding to some other issues which he does not want to go into details on.

Cwmorthin should come under "working mines regulations as it has been worked recently.
It will be classed as a "tourist" mine under the proposed mining regulations 2014. Under which there is a requirement to "make safe" entrances.
I believe that Miles is the lease holder and "operator" under the 2014 regs.
I stiil maintain that this overides any crow legislation that might occur in adjacent areas.

We had a Thursday night trip into Cwmorthin a few weeks back. I know of no access issues, as far as I'm aware its business as usual for everyone.
