According to the DCC shaft capping info document (available online at http://www.derbyshire.gov.uk/Images/Treatment%20of%20Disused%20Lead%20Mine%20Shafts%201_tcm2-212095.pdf ) the responsibility for an abandoned mine would normally lie with the owner of the mineral rights, and only if the owner of the mineral rights cannot be traced does this responsibility pass to the landowner, presumably as they are then assumed to be the de facto owner of the mineral rights.
