Just watched an article on BBC's Countryfile program demonstrating the gravity train. Will be on the BBC Iplayer for the next week, it's worth a look, item starts about 10 mins into the program.

Light thinks it travels faster than anything but it is wrong. No matter how fast light travels, it finds the darkness has always got there first, and is waiting for it.

Yep, they seem to have quite a bit of coverage tonight, I seem to recall there might just be some other railways in Porthmadog too.

It occurred to me several times that the Phase 4 of the WHR (Rhyd Ddu to Porthmadog) would have made a nice "unauthorised" run. Common sense prevailed unfortunately!

I wonder what you could be charged with. Not stealing, if you used your own loco. Trespass isn't a criminal offence. Doubtless there is some antique bylaw you could be prosecuted under!

I'm sue the various regulations relating to railways and their management would provide ample choice....

My understanding is that trespass on a railway is a criminal offence.

There may be room for some interpretation as I'm fairly sure 'The Railway Police' do not operate on private railways?

Her Majesty's Inspector of railways covers ALL railways, and the regulations are the same. Anyway, the railways were denationalised a long while ago... so all railways are privately owned.

We have a rail link to a landfill site passing right next to our mine.
The town police take very little notice if we complain about rogue motorcycles or 4x4s.
If they are also riding on the railway property and we complain to the Transport Police, they take it very seriously.
I was told by them that they view someone with a vehicle on their track as attempting to commit murder of the train driver!

Presumably that is part of Notwork Fail. WHR is not part of the national network and never was, so presumably different laws/byelaws/regulations apply? I am aware, of course, that it still comes under HMRI (now part of ORR).

Yes, the landfill link is 'ordinary' railways.

http://www2.dft.gov.uk/pgr/rail/legislation/regs/railwaysbyelaws.pdf  apply to all public railway in the UK.

http://www.btp.police.uk/  states "British Transport Police is the national police force for the railways providing a policing service to rail operators ..." which would suggest they include operators like the F&WHR in their remit.
However, we do seem to be drifting away for mine exploration on this thread. :offtopic:

My ignorance of the regulations and the enforcement of such has prompted a bit more lateral thinking.

How might the law apply to Snowdon Mountain Railway, bearing in mind the almost daily mass trespass, lack of fencing etc.

I am still not sure that those regs quoted by DaveL apply to railways that were never part of the "British Railways Board", as reading through quickly it seems to refer to BRB several times.

So, I would doubt they apply to SMR or F&WHRs although you might have the bizarre situation where it might apply between Caernarfon and Dinas.

I have often thought it surprising that the FR is not fenced along the Cob!
